Obligations to apprentices and trainees
Business and employer responsibilities
Responsibilities of the supervising registered training organisation
Once entered into a training contract, and having negotiated a training plan, both employers and supervising registered training organisations have a number of responsibilities during the apprenticeship or traineeship.
Business and employer responsibilities
A business or employer must:
- deliver training to the apprentice or trainee as required in the training plan;
- ensure the apprentice or trainee is adequately supervised in the workplace;
- pay wages and provide entitlements as specified in the relevant employment agreement or award;
- carry out all other obligations required of an employer, including those related to safety and fair treatment;
- release the apprentice or trainee from work duties to participate in training delivered by the training provider, as outlined in the training plan;
- notify the Queensland Department of Education, Training and the Arts within 14 days of any of the following events:
- amendment, temporary assignment or cancellation of the training contract;
- sale or disposal of the business;
- dissolution or change of a business partnership;
- the business/employer has ascertained that an apprentice or trainee is not making reasonable progress in the apprenticeship or traineeship;
- the business/employer has ascertained that an apprentice or trainee will not complete their training within the timeframe shown on the training plan.
Responsibilities of the supervising registered training organisation
The supervising registered training organisation is obliged to:
- provide the employer with induction information on their rights and responsibilities under the training contract;
- ensure the business or employer has the range of work and facilities required to train the apprentice or trainee;
- advise the business or employer on the costs of training;
- provide advice to apprentices or trainees on any student fees or other charges they may have to pay;
- provide advice on travel accommodation subsidies;
- work with the business or employer - and the apprentice or trainee - to design a training plan, including the training that needs to occur, how and when that training will take place, who will provide the training, and how that training will be assessed;
- provide the apprentice or trainee with a training record, together with any other materials essential for their training;
- train the apprentice or trainee as required under the training plan, and assist the business or employer to ensure training is completed on schedule;
- regularly make contact with the business or employer to review the progress of training;
- deliver additional learning support, if required, to the apprentice or trainee;
- issue the nationally recognised qualification.
