Fact sheet 123: Interstate apprentices and trainees

The Queensland Department of Education, Training and the Arts often receives enquiries regarding the implications of interstate residence on apprenticeships and traineeships in Queensland, and the recommencement of an apprenticeship or traineeship in Queensland after serving part of the apprenticeship or traineeship interstate.

Where the workplace address of an apprentice or trainee, as entered in the training contract, is not located within Queensland, these applicants cannot be registered in Queensland, as the Vocational Education, Training and Employment Act 2000 does not apply to apprentices and trainees who are not employed within the Queensland borders.

An apprentice or trainee can have an interstate physical and/or postal address and still be registered by the Queensland Department of Education, Training and the Arts, if the physical workplace locality is in Queensland and the apprentice or trainee works at that locality, e.g. the residential address is in Murwillumbah, New South Wales and the actual physical work address is in Coolangatta, Queensland.

Employers and apprentices or trainees with a workplace locality outside of Queensland, need to contact the state training authority relevant to that locality to register the apprenticeship or traineeship.

In the case of group training organisations and the host employer arrangement, if the workplace address of the host employer-i.e. the locality where the apprentice or trainee actually works-is not located within Queensland, then the training contract for the apprentice or trainee cannot be registered in Queensland. The workplace address of the initial host employer may be identified in the training contract at Question 35. It is the responsibility of the group training organisation to conform to this policy.

It is possible for apprentices and trainees who have partly completed their apprenticeship or traineeship interstate to recommence their training in Queensland. Credit can be given for 'time served' interstate, which will apply against the nominal term of the apprenticeship or traineeship.

It is the responsibility of the parties to the training contract, and the supervising registered training organisation, to negotiate the training plan, establish the training re-entry point and the training to be completed. The employer must be familiar with the industrial instrument that applies to the apprenticeship or traineeship in question, to ensure that the relevant wage entitlement is paid.

Any of the parties to the training contract may object to the amount of credit claimed or granted. If an objection occurs, written advice to the local regional office of the Queensland Department of Education, Training and the Arts must be provided within 14 days of the notification of the credit being granted. The written advice must include the reasons for the objection and the amount of credit considered appropriate. Notification by the department will usually be in the form of a letter sent to the employer and the apprentice or trainee at the time of registration of the training contract. This letter will identify the nominal completion date of the training contract.

Credit cannot be allowed unless the apprentice or trainee provides appropriate documentation from the former interstate training authority with the training contract. This documentation must confirm the trade calling or traineeship occupation, the cancellation of the interstate training contract/s and the period/s served under the interstate training contract/s. This documentation is usually in the form of an Extract of Service and must be an official document from the former interstate training authority. A Statement of Attainment from the former interstate registered training organisation must also be provided to the supervising registered training organisation.
